Termination Process
  • Whether a specific reason is needed for termination depends on an employer's total number of employees and the length and type of service of the individual being dismissed. An employee dismissed during their first six months with an organization (or 12 months if it is a small business) cannot generally make an unfair dismissal claim to the Fair Work Commission.
Notice Period

Notice periods are determined by the amount of time that the employee has been employed and their age:

  • Under one year of employment: 1 weeks’ notice
  • Between one and three years of employment: 2 weeks’ notice
  • Between three and five years of employment: 3 weeks’ notice
  • Over five years of employment: 4 weeks’ notice
  • Employees who are over 45 and have been employed for at least two years are entitled to an extra week of notice.

The amount of severance pay awarded is based on an employee's continuous period of service:
Between 1 and 2 years – 4 weeks’ pay
