Sick days

Employees are entitled to 30 days of sick leave paid by their employer (the amount due being specified in the employment contract or collective agreement). If the illness or injury causing the absence is work-related, payment should be 100% of the employee's salary. Any sick leave beyond 30 days is paid for by social security.

Maternity leave

Paid maternity leave is 105 days, starting 28 days before the due date. Taking a minimum of 15 das is required by law. Employees are only eligible for maternity leave if they have paid at least a year's worth of insurance contributions in the previous three years (the amount that the employee is entitled to depends on the amount they have contributed).

Paternity leave

Paid paternity leave is 30 days, half of which must be taken in the first six months of the child's life. The amount due is calculated based on average earnings in the previous year (up to a maximum of 2.5 times the national average monthly salary).

Termination

Termination Process

Termination processes vary depending on the type of contract, reason for termination, the employment agreement, and any collective agreements in place. Dismissals can be classified as regular (e.g. misconduct) or extraordinary (e.g. on account of committing a crime). All dismissals must be made in writing and the employee being dismissed must have the opportunity to make a case in their defense.

Notice Period

Notice periods are determined by length of service (or circumstances):

  • During probation period: 7 days
  • Extraordinary dismissal: no notice
  • Up to one year (or an at-fault dismissal): 15 days’ notice
  • Between one and two years: 30 days’ notice
  • Over two years – 30 days plus two days for every year served above two
Severance Pay

The amount of severance pay depends on length of service

  • Under one year: none
  • Between one and ten years: 1/5th of salary for each year of service
  • Between ten and 20 years: 1/4th of salary for each year of service
  • Over 20 years: 1/3rd of salary for each year of service
Probation Period

Probation periods are set out in the employment contract and can be for up to a maximum of six months.
